Terms of Service

1. Introduction & Definitions
These Terms of Service ("Terms") govern your use of the Tailwind platform ("Service"), operated by Tailwind Ltd ("we", "us", "our"), a company registered in England and Wales.
"User" or "you" refers to any individual or entity accessing the Service. "Booking" means a confirmed flight reservation monitored by our Service. "Rebook" means the process of cancelling an existing booking and replacing it with a lower-priced equivalent. "Saving" means the gross difference between the original fare and the rebooked fare. "Fee" means the charge applied by Tailwind upon a successful rebook.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. Service Description
Tailwind provides an automated fare monitoring and rebook service for business and first class flights. Our Service includes:
(a) Fare Monitoring: We continuously check the price of your booked flight against current market fares using airline distribution systems.
(b) Price Alerts: When we detect a fare lower than your current booking, we notify you via your chosen communication channel (SMS, email, or push notification).
(c) Auto-Rebook: Subject to your settings and confirmation, we execute a rebook by securing the new lower fare before cancelling your existing booking, ensuring you are never left without a valid ticket.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information, including your full legal name, email address, phone number, and payment details.
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorised access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.
4. Fees
Tailwind charges a fee of 20% of the gross saving achieved through a successful rebook, subject to a minimum fee of GBP 11 (eleven pounds sterling).
Fees are charged only upon successful completion of a rebook. No fee is charged for monitoring, alerts, or unsuccessful rebook attempts.
Examples:
- Saving of GBP 200: Fee = GBP 40 (20% of GBP 200)
- Saving of GBP 30: Fee = GBP 11 (minimum fee applies, as 20% of GBP 30 = GBP 6)
Fees are collected automatically via your registered payment method. VAT is applied at the prevailing UK rate and itemised on your invoice.
5. The Rebook Process
When a price drop is detected that meets your minimum saving threshold, the following process is initiated:
(a) You receive an alert with the saving amount and new fare details.
(b) You have a 60-second confirmation window to approve or decline the rebook.
(c) If auto-confirm is enabled, the rebook proceeds automatically.
(d) We employ a "new-before-cancel" approach: the replacement booking is secured before the original is cancelled, ensuring you always have a valid ticket.
(e) Upon successful rebook, your new booking details (including updated PNR) are sent to you, and the Tailwind fee is charged.
If the rebook fails for any reason (e.g., fare no longer available, payment failure), your original booking remains untouched and no fee is charged.
6. Cancellation & Refunds
You may cancel your Tailwind account at any time through your account settings. Upon cancellation:
- Active fare monitoring ceases immediately.
- Any pending rebook operations are cancelled.
- No further fees will be charged.
- Fees already charged for completed rebooks are non-refundable, as the service has been fully delivered.
If you believe a fee has been charged in error, please contact us at ops@tailwind.com within 14 days of the charge.
7. Limitation of Liability
To the maximum extent permitted by law:
(a) Tailwind provides the Service on an "as is" basis and makes no warranties regarding the availability of fare reductions.
(b) We are not liable for any losses arising from airline schedule changes, fare rule modifications, or third-party system outages.
(c) Our total liability to you in any 12-month period shall not exceed the total fees paid by you during that period.
(d) We are not liable for indirect, consequential, or incidental damages including lost profits, lost savings, or travel disruption.
(e) Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded.
8. Data Protection
We process your personal data in accordance with our Privacy Policy and applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Your data is processed for the purpose of providing the Service and is handled with appropriate technical and organisational safeguards. For full details, please refer to our Privacy Policy.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
